Program Overview: The WiseHeart is an online social and emotional learning platform designed to cultivate student well-being. It integrates with Google Classroom, allowing educators to enroll classroom rosters and where applicable, gain access to relevant course materials and resources.
Data Privacy and Security:
1. Authorization: By using the program to enroll classroom rosters, you acknowledge and agree that HeartMath Institute will have access to certain data and information from your Google Classroom account, including student and teacher names, email addresses, and class enrollment data. You authorize HeartMath Institute to collect, use, store, and process this data for the purpose of providing the program and its associated services.
2. Confidentiality: HeartMath Institute is committed to maintaining the confidentiality and security of the data obtained from its users, including those who use Google Classroom. We will handle this data in accordance with applicable data protection laws and our Privacy Policy. We will not sell, rent, or lease your data to any third parties.
3. Security Measures: HeartMath Institute will implement reasonable security measures to protect the data obtained from Google Classroom. However, please be aware that no security measures are foolproof, and we cannot guarantee the absolute security of your data.
Use of Classroom Roster Enrollment:
1. Authorized Use: You may use the program to enroll classroom rosters solely for educational purposes within your authorized educational institution or organization.
2. Data Accuracy: You are responsible for ensuring the accuracy and currency of the classroom roster data you enter into the program.
3. Compliance with Laws: You agree to use the classroom roster enrollment feature in compliance with all applicable laws, regulations, and policies, including but not limited to data protection and privacy laws.
Intellectual Property: The program, including its content, materials, and resources, is protected by intellectual property rights owned by HeartMath Institute or its licensors. You acknowledge that you do not acquire any ownership rights by using the program. You agree not to modify, reproduce, distribute, or create derivative works based on the program or any part thereof.
Modifications and Termination: We reserve the right to modify, suspend, or terminate the program or any part thereof, at any time but prior notice. We may also update these terms from time to time. Any modifications to the terms will be effective upon posting of the updated version. Your continued use of the program after any modifications constitutes your acceptance of the updated terms.
Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with the program or these terms.
Governing Law and Jurisdiction: These terms shall be governed by and construed in accordance with the laws of the jurisdiction where HeartMath Institute is located. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
Entire Agreement: These terms constitute the entire agreement between you and HeartMath Institute regarding the program and supersede all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the program.
